What is a Trademark?

According to the Trademark Act, 1999 “Trademark” means a mark capable of being represented graphically and capable of distinguishing the goods or services of one person from those of others.
It can also include a shape of the goods, packaging of the goods or colour combination.

Trademark Registration

Trademark registration is a process in which you protect your brand name, logo, symbol, slogan, sound or design through legal means. After successful Trademark registration you will be assured that no one else can use the same name, logo, symbol, slogan, sound or design you have chosen for your company. The Trademark is governed in India under the Trademarks act,1999.
For trademark registration Form TM-A needs to be submitted to the Trademark office. After the registration while it is in progress you may use the “TM” symbol (™) with your brand name to show that you are claiming trademark rights. After successful registration you can use the ® symbol to show that you have the right over the brand name, logo, symbol, slogan, sound or design.

There are three types of trademark symbols which is used by us

  • TM symbol (™) – It is used by the brands who has filed their application for registration and it is under process to show that you are claiming trademark rights.
  • SM symbol (℠) – It is used for unregistered service providers.
  • R Symbol (®) – It can be used after the successful registration process and you get the official certificate. After taking you can legally take actions if somebody try to copy your brand name, logo etc.

What is Trademark Class?

All the goods and services are categorised in different classes under Trademark Act,1999. While registering yourself in Trademark first you need to know about the class under which your Goods or Services falls.

There are 45 different classes. You must choose the correct one before filing the form of registration.

  • Classes 1 to 34: Goods
  • Classes 35 to 45: Services
If your business falls under multiple classes, you have to register under multiple classes and take the certificate for all the classes.
